These Terms of Service (hereinafter "Terms") govern access to and use of the ProfNova platform (hereinafter "the Platform"), operated by ProfNova SAS, a simplified joint-stock company registered in France. By accessing the Platform or creating an account, you agree to these Terms without reservation.
Purpose of the Platform
ProfNova is a platform that connects students seeking private lessons with independent tutors offering their teaching services. ProfNova is not a training organisation and does not employ tutors. The Platform facilitates the search, booking, and payment for private lessons online or in person.
Registration and User Account
To use ProfNova's services, you must create an account by providing accurate and up-to-date information. You are responsible for keeping your login credentials confidential. All activity on your account is carried out under your responsibility. If you are a minor, registration must be completed by a legal guardian. ProfNova reserves the right to suspend or delete any account that does not comply with these Terms.
Tutor Status
Tutors registered on ProfNova operate as independent contractors. They are solely responsible for their tax and social obligations. ProfNova does not guarantee the quality of lessons or tutors' qualifications, although verification and rating mechanisms are in place. Tutors commit to providing accurate information about their profile, qualifications, and experience.
Booking and Payment
Lessons are booked through the Platform based on availability set by tutors. Payment is made online at the time of booking by credit card or other available payment methods. ProfNova charges a service fee on each transaction. Displayed prices include the Platform's commission. Applicable VAT is indicated in accordance with French law.
Cancellation and Refunds
In accordance with Articles L. 221-18 et seq. of the French Consumer Code, you have a 14-day withdrawal right from the date of service subscription. However, if the lesson has been delivered during this period, the withdrawal right can no longer be exercised. Cancellations made more than 24 hours before the lesson start time are eligible for a full refund. Cancellations made less than 24 hours before the lesson may incur cancellation fees.
Intellectual Property
All elements of the Platform (text, graphics, logos, images, software) are the exclusive property of ProfNova or its partners and are protected by intellectual property law. Any unauthorised reproduction, representation, or use is prohibited.
Liability
ProfNova acts as a technical intermediary and shall not be held liable for the content of lessons delivered, disputes between students and tutors, or the accuracy of information published by users. ProfNova implements reasonable measures to ensure the availability and security of the Platform, without any obligation of result.
Changes to the Terms
ProfNova reserves the right to modify these Terms at any time. Users will be notified of any material changes by email or through a notification on the Platform. Continued use of the Platform after notification constitutes acceptance of the updated Terms.
Governing Law and Disputes
These Terms are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution before taking legal action. In accordance with Articles L. 611-1 et seq. of the French Consumer Code, you may refer to a consumer mediator. Failing amicable resolution, the competent courts of Paris shall have exclusive jurisdiction.
